1. Acceptance of Terms
By using GATE Express Carwash's website, services, and facilities, you agree to be bound by these Terms of Service. If you do not agree to any part of these terms, please do not use our services.
2. Use of Services
You agree to use our services only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment. Prohibited behavior includes:
- Harassing or causing distress or inconvenience to any person
- Obscene or offensive language
- Disrupting the normal flow of dialogue within our locations
- Damaging or vandalizing our facilities or equipment
- Endangering the safety of others
3. Daily Wash Club Terms
Membership Eligibility
Daily Wash Club memberships are available to individual consumers and valid at any of our 21 locations. One membership per person. Commercial fleet accounts are not eligible for consumer daily wash plans.
Usage Rights
Your membership provides one wash per calendar day of your selected tier at any location. Transfers to other individuals are not permitted.
Tier Features
Each membership tier includes specific wash packages and features. Upgrades and downgrades may be made during your membership cycle and will take effect on the next renewal date.
4. Payment and Billing
All membership payments are recurring charges on a monthly basis. You authorize GATE Express to charge your selected payment method on the renewal date each month. You are responsible for keeping your payment information current. Failed payment attempts may result in account suspension.
5. Cancellation Policy
You may cancel your membership at any time by contacting us at least 7 business days before your next billing date. Cancellations received after 5 PM on the 7th day before renewal will be effective on the following billing cycle. No refunds are provided for unused membership time.
6. Limitation of Liability
To the maximum extent permitted by law, GATE Express shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the services, facilities, or content, even if we have been advised of the possibility of such damages.
7. Vehicle Damage Claims
Our staff performs vehicle washes to industry standards. In the unlikely event of damage, you must report the incident to management immediately and provide photographic evidence within 24 hours of the incident. Claims reported after 7 days will not be considered. GATE Express's liability for damage is limited to direct restoration costs not exceeding the cost of one service.
8. Prohibited Uses
You agree not to:
- Use automated systems to access our website without permission
- Attempt to gain unauthorized access to our systems
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Provide false information in your account
- Harass, threaten, or abuse our staff
9. Intellectual Property
All content on our website and materials provided are the exclusive property of GATE Express Carwash. You may not reproduce, distribute, or transmit any content without our prior written permission.
10. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Florida, and you irrevocably submit to the exclusive jurisdiction of the courts located in Duval County, Florida.
