GATE Petroleum Company and its affiliates (“we,” “us,” or “our”) are committed to protecting your non-public personal information and providing a safe and secure online environment when using our websites and applications, including all pages and sub-domains, and which may change from time to time (collectively, the “Sites”).

The purpose of this Privacy Policy (this “Policy”) is to provide an understanding of our practices regarding the information that we may collect when you access the Sites, how we may disclose and use the information, and how we may make corrections and updates to the information. If you do not agree with this Policy, please do not access or use the Sites.

We reserve the right to change this Policy at any time. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to, posting the revised Policy on this page. The date of the last revision of this Policy is set forth above at the top of this page and should be checked by you periodically. Your continued use of the Sites after such modifications will constitute your acknowledgment of the modified Policy and your agreement to abide and be bound by the modified Policy.

  1. Information Collection
    1. Personal Information

      The Sites include the opportunity for you to register and provide information that may personally identify you and the companies with which you are affiliated. Some features of the Sites may be used without such registration or information but both are required to use certain functionality.

      When you register with the Sites, you will create a user profile, which will include information such as your name and the name of the companies with which you are affiliated, geolocation information, physical address information, telephone numbers, email addresses, user IDs and passwords, transaction information, contact preferences and the like (collectively, “Profile Information”). We will receive and record this Profile Information. The Profile Information may include personal information about you (collectively, “Personal Information”). The Sites may also collect other forms of Profile Information and Personal Information, such as search queries you conduct on the Sites and your responses to surveys and questions and your completion of forms.

    2. Non-Personal Information

      We also gather additional non-personal information on the Sites, such as data about usage and

      service operation that is not associated with a specific personal identity (“Non-Personal Information”). Non- Personal Information we collect may include technical information about accessing computer hardware and software such as IP addresses, browser types, domain names, referring websites addresses, pages visited on the Sites, and time spent on the Sites. We use software tags called “cookies,” web beacons and other technologies for data analysis and personalization services. More information about our use of Non- Personal Information is set forth in Section 5 below.

    3. Your Submissions

      Certain areas of the Sites may permit you to communicate, submit, upload or otherwise make available text, images, audio, video, competition entries or other content (“Submissions”). If you choose to provide any Submissions, you do so at your own risk. We will not treat Submissions as Personal Information. We may, in our discretion, use, reproduce, transmit, print, publish, publicly display, exhibit, distribute, redistribute, copy, index, comment on, modify, adapt, translate, create derivative works based upon, publicly perform, make available and otherwise exploit such Submissions, in whole or in part, in all media formats and channels now known or hereafter devised (including in connection with us and on third party sites and platforms such as Facebook, YouTube and Twitter), in any number of copies and without limit as to time, manner and frequency of use, without further notice to you, with or without attribution, and without the requirement of permission from or payment to you or any other person or entity. We may preserve Submissions, and may disclose Submissions, if required to do so (a) by law or other legal process,

      (b) to enforce an agreement, (c) to respond to claims that Submissions violate the rights of third parties, or

    4. to protect the rights, property or safety of us, our users or the general public. You agree that we may retain copies of all Submissions. We reserve the right, in our discretion, to reject any Submissions at any time without notice to you. We are not responsible for the privacy or security of any Submissions. You must have the right to disclose and transfer all content and information contained in the Submissions, and you may not violate any other person’s privacy or intellectual property rights.
  2. Disclosure and Use of Personal Information

    We may share Personal Information. We may disclose some or all of your Personal Information to business partners. Business partners may include, but are not limited to, our affiliates and companies that provide services in connection with ours. We do provide some of our services through contractual arrangements with affiliates, vendors, services providers, credit card and payment processing providers, advertisers, sponsors, business partners and associates and other third parties (“Business Parties”). We and our Business Parties use your information to operate the Sites and to deliver services. We will encourage our Business Parties to adopt and post privacy policies. However, Business Parties’ use of Personal Information is governed by the respective privacy policies of those Business Parties, and is not subject to our control. We may work with Business Parties to obtain specific services or to perform functions on our behalf, and the Business Parties may have access to Personal Information as necessary to provide those services and perform their functions. For example, credit card, debit card and other forms of online payments made to conduct online transactions are provided to and processed by one or more third parties and payment processors. The Sites may also incorporate application program interfaces and other software and applications owned, operated or managed by third parties. The privacy policies of these third parties will apply to the Personal Information you submit, rather than this Policy. We may transfer Personal Information across state and country borders for the purposes of data consolidation, storage, and simplified customer information management. We may transfer Personal Information to any person or entity succeeding to our business, including as a result of the sale of all or substantially all of our assets or a merger. We may be required by law enforcement or judicial authorities to provide information to the appropriate governmental authorities. We will disclose information upon receipt of a court order, subpoena, or to cooperate with a law enforcement investigation. We fully cooperate with law enforcement agencies in identifying those who use the Sites or our services for illegal activities. We reserve the right to report to

    law enforcement agencies any activities that we in good faith believe to be unlawful. We may also provide information about our customers’ sales, traffic patterns, and related sites information to third party advertisers. We may also use information to help provide and personalize the services you request and expect from us, to conduct direct marketing and sales promotions and to better enhance your experience at the Sites or in using any of our services or those of our affiliates.

  3. Subscriptions by Email or Messaging

    We may use the Personal Information we gather on the Sites, including contact information, to inform you and others via email or other communications regarding the following: information and reminders about our services and scheduled appointments and reservations, additional and new products and services available from us or our sponsors, updates at the Sites, newsletters, or requests for opinions on current products and services or potential new products and services that we may offer. If you no longer wish to receive such information from us, you can opt-out by: (a) following the instructions provided in the initial emails or messages you receive; (b) sending an email to the address listed above with the instructions about which information you would like to remove; or (c) if an available feature, accessing your account at the Sites to change your preferences.

    Notwithstanding anything contained in this Policy to the contrary, we may use, as we deem appropriate, statistical data generated through use of the Sites provided that neither our use nor the statistical data result in the disclosure of any Personal Information that will directly or indirectly identify you. Our email communications to you may use a click-through URL linked to the Sites. When you click on one of those URLs, we will track this click-through data to measure the effectiveness of our customer communications. If you prefer not to be tracked in this manner, you should not click on any text or graphic links in our communications to you.

  4. Security of Certain Information

    Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your information, you acknowledge that: (a) there are security and privacy limitations of the Internet which are beyond our control; (b) the security, integrity and privacy of any and all information and data exchanged between you and us through the Sites cannot be guaranteed; and (c) any such information and data may be viewed or tampered with in transit by a third party. We use commercially reasonable safeguards and security procedures to keep Personal Information and Profile Information confidential and secure from unauthorized access, disclosure, use, alteration, unlawful destruction, or accidental loss. We do not guarantee that unauthorized third parties will never be able to defeat these measures or access and use Personal Information for improper purposes. We assume no liability in those circumstances, nor for any Personal Information once it is transported onto a managed communication network (including the Internet).

    The security of your online profile relies on your protection of your Profile Information. You are responsible for maintaining the security of your user Profile Information, including your password and for all activities that occur under your account. You may not share your password with anyone. We will never ask you to send your password or other sensitive information to us in an email, though we may ask you to enter this type of information on the Sites.

    Any email or other communication purporting to be from the Sites requesting your password or asking you to provide sensitive account information via email, should be treated as unauthorized and suspicious and should be reported to us immediately by emailing the above email address. If you believe someone else has obtained access to your password, please change it immediately by logging in to your account and report it immediately by emailing the above email address.

  5. Disclosure and Use of Non-Personal Information; Cookies

    We receive an IP address and access date and time information each time you view a page from the Sites. We may use IP addresses for various purposes, including to diagnose reported service or technical problems associated with IP addresses, or to estimate the total number of users visiting the Sites from specific localities, countries, or regions of the world. As previously mentioned we may set cookies on the requesting computer and later access those cookies to help personalize and maximize the online experience and time online. A “cookie” is a small amount of data, stored on the requesting computer’s hard drive that often includes a unique identifier sent to a browser requesting to view a web page. We store “cookies” and use them in connection with your use of the Sites. We may use Business Parties to display banner advertisements or other content on the Sites. As part of their service, they may place a separate cookie on your computer. We have no access to or control over these Business Parties. We and our Business Parties will collect and use information about you, such as your IP address, browser type, the server your computer is logged onto, geolocation information, the area code and zip code associated with your server and whether you responded to a particular ad. Other advertisers may also place banner ads on the Sites in the same manner as above. Normally, the preferences in your web browser can be set to accept all cookies, reject all cookies, or notify you when a cookie is set and permit you to accept or decline cookies on an individual basis. It is your responsibility to set the preferences in your web browser to the security levels you are comfortable with. However, if you set the preferences to reject all cookies, it may impact your experience on the Sites. This Policy covers only our use of cookies and does not cover the use of cookies by any advertisers, sponsors or any of our other Business Parties or affiliates.

  6. Links and Third Party Sites

    As a courtesy to you, the Sites may contain links to websites and resources owned by other individuals and entities, including those of our affiliates and sponsors, or may bring such third party material and resources into the Sites via “inverse hyperlinks” and framing technology (collectively, the “Third Party Sites”). As an example, we may enable you to apply for or submit information in connection with seeking employment with us or with one of our related companies. In such instances, we may provide links to Third Party Sites where employment related information may be input by you and collected by such third parties. We have no access to or control over Third Party Sites or cookies used by Third Party Sites. When you access those links, you are leaving the Sites and are accessing the Third Party Sites at your own risk. We are not responsible for the privacy practices of other Third Party Sites; nor do we endorse, and we are not responsible for, the information and content contained on Third Party Sites; nor are we responsible for maintaining links to or availability of Third Party Sites. We encourage you to check the privacy policies of Third Party Sites before disclosing any non-public personal information.

  7. The Sites and Children

    We do not knowingly collect personally identifiable information from children without permission from a parent or guardian. If you are a parent or legal guardian and think your child has given us information, you can contact us at the address listed above and we will use our best efforts to remove the personal information permanently from our files and will take any additional required measures under the Children’s Online Privacy Protection Act of 1998.   8. Your California Privacy Rights

    Residents of the State of California, under the California Civil Code, may choose to make certain requests regarding Personal Information obtained by companies doing business in the State of California.

  9. Modifying Account Information and Opting Out

    You have the opportunity to ask us not to share information with third parties or to opt-out of our use of Personal Information.   10. Users Outside the United States

If you decide to visit the Sites, or share your Personal Information with us, you are agreeing to be governed by the laws of the United States, and you are expressly consenting to the transfer of your data to the United States.
